  1. CHILDREN’S MIRACLE NETWORK HOSPITALSDANCE MARATHON HACKATHON2020OFFICIAL RULESNO PURCHASE, PAYMENT OR DONATION OF ANY KIND IS NECESSARY TO ENTER OR WIN. ANY PURCHASE, PAYMENT OR DONATION WILL NOT INCREASE THE CHANCES OF WINNING. VOID WHERE PROHIBITED.BY REGISTERING FOR THE CONTEST, ENTERING THE CONTEST, AND OR SUBMITTING A PROPOSAL, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF ADMINISTRATOR AND THE JUDGES, WHICH SHALL BE FINAL IN ALL RESPECTS.Contest Overview: Children’s Miracle Network d/b/a Children’s Miracle Network Hospitals, a Utah nonprofit corporation located at 205 West 700 South, Salt Lake City, Utah, 84101,(“CMN Hospitals”),raises funds for its member children’s hospitals through its Dance Marathonprogram(“Dance Marathon”). CMN Hospitals inviteseligible participants to participate in Dance Marathon Hackathon2020, a contest in which eligible participants (“Participants”) may submit a proposal (a “Proposal”) in one of the following six categoriesto boost fundraising and awareness for children’s hospitals: (1) Dance Marathon Community Engagement, (2) Cause Awareness Campaign, (3) Dance Marathon Fundraising, (4) Dance Marathon Virtual Engagement, (5) Dance Marathon Event Experience or (6) Blue Sky Innovation(the “Contest”).These categories are explained in full at are incorporated into these Official Rules by reference.1.Eligibility:The Contest is open to individualswho are at least eighteen (18) years old and who are legal residents of the United Statesand Canada. Employees, directors, board members, officers of CMN Hospitals, members of the judging panel,and their immediate family members are not eligible to participate. Immediate family members are defined as spouse, domestic partner, parents, legal guardians, grandparents, siblings, children and grandchildren, by current or past marriage(s), remarriage(s), adoption or co-habitation, and any other persons residing at the same household whether or not related. CMN Hospitalsreserves the right to verify the eligibility of each Participant.2.Registration: All Participants who wish to participate in the Contest must register for the Contest and submit a proposal online at By registering, Participants certify that they are eligible and agree to be bound by these Official Rules and the decisions of the judges, which shall be final in all respects.Brief:Additional information regarding the content of Proposals and tips for success can be found at the headings “Key Success Criteria” and “How the Judging Works.” The contents of those sections are hereby incorporated into the Official Rules.
    2CMNH 5-8-203.Submission:NO DONATION OR PURCHASE NECESSARY TO ENTER. Each Proposal may only be submitted by up to three(3) Participants working as a team(each a “Participating Team”). Participants and Participating Teams may submit one (1) Proposal each.The Deadline to submit Proposals is May 24, 2020at 11:59 pm Eastern Standard Time.Once submitted, the Proposals will be immediately visible at the publicwill be able to view, upvote and comment on them.4.Judging: The Contest involves three(3) rounds of evaluations.(a)Round One. Proposals will first be judged by a panel of judges consisting of CMN Hospitals employees, including employees responsible for the Dance Marathonprogram. The panel of judges will select fourteen(14) Proposals as semi-finalists(the “Semi-Finalists”).Additionally, the one (1) Proposalwith the most upvotesthat has not been selected as a Semi-Finalist will also be selected as a Semi-Finalist. The panel of judges will select the Semi-Finalists based on the following criteria:CriteriaConsiderationsWeightInnovationReflects a creative and innovative approach.1/6Solves a ProblemRepresents a viable solution to a real problem.1/6Easy to Use/ImplementProvides an intuitive user interface and/or experience.1/6Intuitive Provides an easily understood value.1/6FunctionalCan functionally demo and is easy to scale.1/6Technology DrivenLeverages a variety of technologies in a unique way.1/6(b)Round Two. Thefifteen (15) Semi-Finalist Proposals will be posted for public commentno later than 12:01am Eastern Standard Time on May 28, 2020. The public will be able to comment on the proposalsuntil June 1, 2020 at 11:59 pm Eastern Standard Time, although those comments will not affect judging in this round. The Semi-Finalist Proposals will be judged by a panel of judges consisting of four (4) to six (6) CMN Hospitals employees and/or subject matter expertschosen by CMN Hospitals in its sole discretion. Four (4) finalists (the “Finalists”) will be chosen from the fifteen (15) Semi-Finalist Proposals based on the same criteria specified in the table in Section 2(a), above. The four (4) Finalists will be announced on June 5, 2020, at Three. 
    3CMNH 5-8-20(i)The four (4) FinalistParticipants and/or Participating Teamswill be invited to participate in a final judging event (the “Finals Event”)held on July 9, 2020, as part of CMN Hospitals’ Dance Marathon Leadership Conference.If a FinalistParticipant and/or Participating Team is not able to participate in theFinals Event, each such Participant and/or Participating Teamwill be disqualified from the Contest and will forfeit any right to participate further in the Contest or receive any prize. If a FinalistParticipant and/or Participating Teamisunableto participate inthe Finals Event, that Finalistmaynot be replaced with another Participantor Participating Team. (ii)Prior to the Finals Event, each of the Finalist Participants and/or Participating Teams will be assigned a mentor to help further develop their Proposal and to help develop their presentation for the Finals Event. (iii)At the Finals Event, the Finalist Participants and/or Participating Teamswill be required to make a presentation of up to fifteen (15) minutesto a panel of judgesmade up of four (4) CMN Hospitals employees and/or subject matter expertsand answer questions posed by the panel of judges for up to ten (10) minutes. The panel of judges at the Finals Event will not consist of any judges who judged submissions in Rounds One or Two of the Contest. The panel of judges at the Finals Event will select one winner of the Contest (the “Winner”). Thepanel of judges at the Finals Event will be comprised of employees of CMN Hospitalsand/or subject matter expertsselected by CMN Hospitals in its sole discretion.The judging panel will select the Winnerbased onthe same criteria specified in the table in Section 2(a), above. The panel of judges will also select threerunners-up(the “Runners-Up”).5.Evaluation Criteria: In the event of any tie, the tie will be broken based on the highest score in the first judging criteria, continuing thereafter to each judging criteria in the order listed above, as needed to break the tie.6.Grand Prize: The Winner of the Contest, whether a Participant or Participating Team,will be announced at the conclusion of the Finals Event and will be eligible to receive the following prizes subject to the terms and conditions of these Official Rules:CMN Hospitals will make a One Thousand Dollar ($1,000) donation to the Winner’s chosen children’s hospital that is a member of CMN Hospitalsandthe choice of one of the following three (3) prizes:oCMN Hospitals will make a one-time, Three Thousand Dollar ($3,000) grant to the Dance Marathon program with which the Winner is affiliated; oroA trip for up to three (3) individuals to Children’s Hospitals Week 2021 in Orlando, Florida, March 28, 2021 through April 1, 2021, including round-trip coach airfare to Orlando, Florida, three (3) nights’ stay in at a nearby hotel selected by CMN Hospitals (double-occupancy), registration fees for Children’s Hospitals Week, ground transportation to and from the Orlando Airport to the hotel, a single, one-day admission ticket to Walt Disney 
    4CMNH 5-8-20World and all meals offered to regular attendees of the Children’s Hospitals Week conference up to Two Thousand Dollars ($2,000); oroA custom Donor Drive theme for the Dance Marathon program with which the Winner is affiliated along with coaching from Donor Drive on how to make the fundraising platform as effective and engaging as possible.7.Runners-Up: CMN Hospitals shall make a Two Hundred Fifty ($250) donation toeach of the three runners-ups’ Participants or Participating Teams’ chosen children’s hospital that is a member of CMN Hospitals.8.Agreement:Participation in the Contest constitutes Participants’ full and unconditional agreement to these Official Rules and to the decisions of CMN Hospitalsand the appointed judges, including their interpretation of these Official Rules and their exercise of discretion, which is final and binding in all respects. 9.Guidelines and Restrictions: (a)Participants must notify Administratorif their contact information has changed.(b)Each Proposal must be the original work of the Participant.(c)Each Proposal must not contain copyrighted material.(d)CMN Hospitals’ computer network will be theofficial time-keeping device for all Contest deadlines.(e)CMN Hospitalsmakes the final determination as to which Participants and Proposals are eligible to take part in the Contest. If a Participant has been convicted of a crime, or if the actual, allegedor publicized conduct of any Participant is illegal, or in CMN Hospitals’sole discretion is otherwise grossly offensive, violates generally accepted standards of behavior, or otherwise leads CMN Hospitalsto believe that public association with any Participant subjects CMN Hospitalsto contempt, controversy, embarrassment or scandal, CMN Hospitals, in its sole discretion, may disqualify Participant and any Proposal associated with such Participant will no longer be eligible for the Contest.10.Ownership/License: Upon submission, each Proposal becomesthe sole and exclusive property of CMN Hospitals and will not be returned. By submitting a Proposal, each Participant grants CMN Hospitals a royalty-free, worldwide, perpetual, non-exclusive license to display, distribute, reproduce, andcreate derivative works of the Proposal(s), in whole or in part, in any media now existing or subsequently developed, for any purpose, including but not limited to use any design, work or contentin future promotional materials related to CMN Hospitals. CMN Hospitalswill not be required to pay anyadditional consideration or seek any additional approval in connection with such uses. 
    5CMNH 5-8-2011.Representations:By entering the Contest, Participant(s)represent that their Proposal(s), including the design, work and content thereof, are original and do not infringe upon any statutory or common law copyright, trademark, contractual, proprietary right, right of publicity or privacy, or any other right of any person or entity. The Proposal(s)must not contain trademarks other than those owned by CMN Hospitals. Participantsshall have no ownership rights in the trademarks, copyrights or other intellectual property owned by CMN Hospitals, and any and all rights and goodwill associated therewith andany and all derivatives remain the property of the CMN Hospitalsand/or are hereby assigned and conveyed by Participants to CMN Hospitals. CMN Hospitals expressly reserves all rights of ownership of its trademarks.The Proposals(s) must not contain depictions of or references to alcohol, tobacco, firearms, gambling or anything that is violent or sexual.12.Notification:If the semifinalists, Finalistsor winnercannot be contacted within a reasonable time, as determined in the sole discretion of CMN Hospitals, or do not comply with these Official Rules, thatpotential semifinalist, Finalist or winnerwill forfeitall rights to further participation in the Contest and any prize. If the potential winner is disqualified for any reason, any prize may be awarded to a runner-up, if any, in accordance with these Official Rules or, if required, by the sole discretion of CMN Hospitals. 13.Taxes: The potential winner may be required to submit an affidavit of eligibility, liability/publicity release (the “Affidavit”) and tax documents and return such documents within the time period specified at notification before being eligible to receive his/her prize. If a potential prize winner fails or refuses to sign and return such Affidavit and/or requested tax documents within the time period required by CMN Hospitalsor if the prize or prize notification is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential prize winner, such potential prize winner may be disqualified and an alternate may be selected.14.Release:Participantsagree to release and hold harmless CMN Hospitals, its affiliatesandeach of those parties’ respective directors, officers, employees, agents and (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or any travel related to the Contest.Participantsfurther agree to indemnify, defend and hold harmless the Released Parties from and against any and all liabilities, demands, claims, suits, actions, losses, costs, expenses, damages, causes of action or judgments incident thereto (including, but not limited to, interest, penalties, and reasonable attorney’s fees) brought or entered against the Released Parties relating to or arising out of participation in the Contest or any travel related to the Contest.CMN Hospitalsreserves the right to cancel, suspend and/or modify the Contest, or any part of it, ifany fraud, technical failures or any other factor impairs the integrity or proper functioning of the Contest, as determined by CMN Hospitalsin its sole discretion. If terminated, CMN Hospitalsmay, in its sole discretion, determine the winners from amongall eligible entries received up to time of such action using the judging procedure outlined above. CMN Hospitalsreserves the right to disqualify any entrant it finds to be tampering with the Contest process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner and void any and all associated entries. 
    6CMNH 5-8-20Any attempt by any entity, person or group to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, CMN Hospitalsreserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. 15.Limitation of Liability: CMN Hospitalsis not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in the Contest; (4) printing, typographical, technical, computer,network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of entries or contents, or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of the Trip (including any travel/activity related thereto). CMN Hospitalsis not responsible for misdirected or undeliverable entries or contents or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. CMN Hospitalsis not responsible for any unauthorized third-party use of any content. CMN Hospitalsis not responsible for responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled,delayed or misdirected entries; all of which will be void.YOU AGREE THAT RELEASED PARTIES: (1) HAVE NEITHER MADE NOR WILL BE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, IN CONNECTION WITH THE CONTEST AND/OR WITH RESPECT TO TRAVEL RELATED TO THE CONTEST; (2) maintain no control over the personnel, equipment or operation of any air, water or surface carrier, ship line, bus or limousine company, transportation company, hotel, manufacturer or other person or entity furnishing services, products or accommodations (“Suppliers”) as a part of travel related to the Contest; and (3) will not be responsible or liable for any injury, damage, loss, expense, accident, delay, inconvenience or other irregularity that may be caused or contributed to: (A) by the wrongful, negligent or unauthorized act or omission on the part of the Suppliers or any of their agents, servants, employees or independent contractors, (B) by any defect in or failure ofany vehicle, equipment, instrumentality, service or product that is owned, operated, furnished or otherwise used by any of those Suppliers, (C) by the wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties, and (D) by any cause, condition or event whatsoever beyond the control of the Released Parties. BY SUBMITTING A PROPOSAL, PARTICIPANTS AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAWTHAT: (1) ANY AND ALL OF YOUR CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (2) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO
